I Want To Be In Pictures - Certification and Release

I hereby certify that the story that I have submitted is true and accurately reflects my personal experience. I also certify that any picture(s) I upload to Metabolife.com or otherwise provide to Metabolife is/are an unaltered picture(s) of me. By submitting my personal story and any picture of myself to Metabolife.com, and in consideration for the opportunity to be featured or displayed on the Metabolife.com website and/or included in marketing and promotional materials relating to Metabolife® brand products and/or the manufacturer of Metabolife® brand products, its parent, subsidiary, affiliated and related companies, and each of their licensees, subsidiaries, successors and assigns (collectively “Metabolife”) and/or their respective products and/or services, and for other good and valuable consideration, the receipt and sufficiency of which I hereby acknowledge, I hereby irrevocably grant to the Metabolife the perpetual worldwide right in all languages, formats and media (whether now or hereafter known or created) to use any photograph or personal story I submit to Metabolife.com and to use my name, story, photograph, likeness, appearance, biographical information, personal statements and/or depictions (including without limitation actual or simulated likeness, photograph, quotations, personal characteristics, audio-visual recordings or other personal identification) (collectively my “Name and/or Likeness”), singularly or in conjunction with other photographs and/or recordings, on the Metabolife.com website or any other Metabolife website and in, and in connection with, the advertising, marketing, promotion, endorsement and/or other exploitation of Metabolife and/or any of its products or services without further compensation. Metabolife has the right but is not obligated to make use of my story, picture(s) or Name and/or Likeness or exercise any of the rights granted to Metabolife by this agreement. I understand that Metabolife will not post or utilize any story, photograph or other items submitted by me that Metabolife finds objectionable for any reason in its sole and absolute discretion.

I expressly understand and agree that any such story, photograph, film, tape or other recording of my Name and/or Likeness, all rights therein, and all results and proceeds derived therefrom, shall be the absolute property of Metabolife, and Metabolife shall have the unlimited worldwide right to copyright, publish, exhibit and otherwise exploit such works, in whole or in part, in any manner Metabolife desires. Further, I understand that others, with or without the consent of Metabolife may use and/or reproduce such photographs and recordings.

I shall have no right of approval, no claim to compensation and no claim (including, without limitation, claims based upon invasion of privacy, defamation or right of publicity) arising out of any use, alteration, blurring, illusionary effect or use in any composite form of my name, picture, likeness or voice. I hereby release Metabolife, and any of its associated or affiliated companies, their directors, officers, agents, employees and customers, and appointed advertising agencies, their directors, officers, agents and employees from all claims of every kind on account of such use. This agreement, its validity, construction and effect shall be governed by the laws of the State of New York. The parties hereto agree to submit to jurisdiction in the State of New York.
